Fishing for the Future: A Strategy for the Fisheries of the Kaipara Harbour

Kaipara Harbour is New Zealand’s largest enclosed waterway. There is increasing evidence of problems with fish stocks in the harbour, this has been of particular concern to Maori. Previous attempts of fisheries management has failed. This Study Group has worked for three years with stakeholders, particularly companies holding large quota in the area, to develop a strategy for a sustainable fishery. This strategy outlines a range of sustainable measures to sustainably manage fish stocks in the harbour, most notably a separate management area for the Kaipara.

The New Zealand Recreational Fishing Council and ors v The Minister of Fisheries and ors

This is a High Court judgment of Harrison J delivered in 2007. The case concerned judicial review proceedings brought by groups representing recreational and commercial fishing interests, challenging the Minister of Fisheries’ allocation decisions of the TAC and TACC for kahawai in 2004 and 2005. Harrison J found the Minister’s 2004 decision to be unlawful to the extent he failed to have proper regard to the social, cultural and economic well-being of the people in fixing the TAC for kahawai, he failed to have regard to ss 7 and 8 of the Hauraki Gulf Marine Park Act 2000 and failed to consider advice from MFish to review bag catch limits for recreational fishers. He directed the Minister to review his 2005 decision in light of these findings.
ICUN Guidelines on Use of Precautionary Principle

The governing body of the IUCN has approved guidelines for applying the precautionary principle in conservation and natural resource management. The precautionary principle provides a fundamental policy basis for anticipating and avoiding threats to the environment: namely, that action to protect the environment may be necessary before scientific certainty of harm is established.

New guidebook summarising key points in building MPA networks based on emerging international best practice was released in April 2007 at the summit meeting of the marine program of the IUCN World Commission on Protected Areas (WCPA-Marine). A full technical report to flesh out the summary report’s framework is expected to be released later in 2007.
