Dead Dolphin Sparks Call to Extend Set Net Ban

A rare dolphin found dead in a Taranaki fisherman’s set net has politicians, environmentalists and commercial fishermen seeking law changes.
The Green Party and Forest & Bird are both calling for the set net fishing exclusion zone on the west coast to be extended after a commercial fisherman caught a rare dolphin off Cape Egmont.
On January 2 he found what he believed to be a dead female Hector’s dolphin in his set net off Cape Egmont.
The man tossed the carcass back into the ocean as required by law and reported the incident to authorities.
Both the Ministry of Agriculture and Forestry and the Conservation Department came back saying the dead dolphin was a Maui’s dolphin, despite not seeing the mammal.
Now a fisheries spokesman wants the catch and dump law reviewed as well.
Under the Marine Mammals Protection Act 1978 anyone found carrying marine mammals without a permit from DOC faces up to six months imprisonment or a $250,000 fine.
As a result fishermen are required to toss any dead, injured or alive bycatch mammal overboard.
This posed a problem when trying to solve the Hector’s v Maui’s debate because DNA sampling could not be carried out.
In 2002 the population of Maui’s dolphins was estimated at 111 and the Hector’s dolphin population at more than 7000.
Other than a small genetic difference the two dolphin species were virtually identical.
Egmont Seafood owner Keith Mawson said he would like procedures put in place that allowed fishermen to bring rare dolphins back to shore for DNA sampling to eliminate any uncertainty.
Green Party spokesman Andrew Campbell said the party would approve DOC granting emergency consent for fishermen to bring rare dolphins back for sampling and research.
DOC marine conservation manager Sean Cooper said DOC would liaise with commercial operators to find a solution which would allow them to bring back marine mammal samples in exceptional circumstances.
The latest bycatch incident has seen the Green Party and Forest & Bird put pressure on the Government to extend the exclusion zone.
The set-net exclusion zone prohibits fishers to charter prime rig fisheries from Maunganui Bluff in Northland to Pariokariwa, near Tongaporutu in Taranaki.
“This death occurred in an area not protected by a set-net ban,” a Green Party press release said.
“If the Government is serious about protecting the Maui’s dolphin then the current restrictions need to be reviewed.”

Sensitivity of Marine Mammals Found in Northland Waters to Aquaculture Activities1268 sighting records of marine mammals around the Northland coast are examined in relation to possible detrimental impacts from proposed aquaculture developments. An attempt is made to identify any critical habitats for marine mammals and assess whether aquaculture will modify the behaviour of the animals significantly. The Bay of Islands and Whangarei Harbour produced the most localized and detailed sightings, and both areas are judged to be critical habitats. Other parts of the Northland coast have the potential to be critical habitats, but at present such a categorization is not supported by the data. Potential threats to marine mammals from aquaculture are reviewed and suggestions for mitigation are made in some instances. A need for further research is identified, particularly to identify critical marine mammal habitats and to quantify impacts from proposed developments.
